Conditions:
To qualify for the promotion the participant must purchase a New Epiphan Product during the Eligible Time Period and trade-in an Eligible Trade-In Equipment.
Eligibility to participate in the Promotion is non-transferable and non-assignable.
The participant must be the legal owner of the Eligible Trade-In Equipment and no liens or other charges can exist on the Eligible Trade-In Equipment. The participant must be able to supply proof of ownership (e.g., by providing a receipt or invoice showing proof of purchase or ownership).
Accurate end-customer owner contact information must be provided at the time of registration regardless of which party (i.e., the end customer or reseller) is completing the registration process. The serial number of the Eligible Trade-In Equipment must be provided at time of registration. Any information that is missing or does not comply with any aspect of these terms and conditions may be rejected by Epiphan in its sole discretion and the participant may be disqualified from participating in the promotion.
Epiphan may at its option ask for the Eligible Trade-In Equipment to be sent to Epiphan and legal ownership will transfer to Epiphan at the time of receipt at an Epiphan office. Customer will package the Eligible Trade-In Equipment properly (meeting all shipping requirements) and securely, with adequate cushioning and protection for the shipment back to Epiphan. Epiphan may at its sole discretion choose to send shipping material for customer to package the shipment.
If Epiphan does not ask for the Eligible Trade-In Equipment to be sent to its offices then customer agrees to dispose of the Eligible Trade-In Equipment within 5 days of receiving the New Epiphan Product. Epiphan reserves the right to ask for proof of disposal and customer must supply it in order to qualify for the promotion.
Once all customer, product and promotion information is received and reviewed by Epiphan or its channel partners, Customer will pay the net price (price less the Promotion credit) for the New Epiphan Product and Epiphan or its channel partner will ship the chosen New Epiphan Product to the customer. If Epiphan asks for the return of the Eligible Trade-In Equipment and customer does not return it, customer agrees to pay the Promotion credit back to Epiphan. Customer will also pay back the Promotion credit to Epiphan if a) the customer fails to destroy or dispose of the Eligible Trade-In Equipment or b) the customer mislead Epiphan or its channel partner in completing the customer, product and promotion information that lead to the Promotion credit being granted. All amounts owing and outstanding bear interest at the rate of 1% per month until repaid.
New Epiphan Product can only be shipped to a physical address and cannot be shipped to post office boxes or import/export agents.
Eligible Epiphan Trade-In Equipment will be deactivated within 5 days of the customer’s receipt of the New Epiphan Product. Once deactivated, Eligible Epiphan Trade-In Equipment will not be usable and will not be re-registered, updated, supported, returned or upgraded.
This promotion cannot be combined with any other offer or promotion.

The promotion and these Terms & Conditions will be governed, construed and interpreted under the laws of the province of Ontario without applying any conflicts or choice of law provisions under such law that might refer the construction or interpretation of any term hereof to the laws of any other jurisdiction.
Participants are bound by these terms & conditions and by the decisions of Epiphan, which are final and binding in all respects.
Except where otherwise prohibited by law, by participating in the promotion, you release and agree to indemnify and hold harmless all Epiphan companies, subsidiaries, and affiliates, and each of their respective directors, officers, professional advisors, distributors, representatives, employees and agencies (collectively, the “Released Parties”) from any liability, obligation, injury, claim, suit, action, cost, expense, loss or damage of any kind, including any tax liability or loss of opportunity, whether direct, indirect, special, incidental or consequential, that may be imposed on, asserted against or incurred by such Released Parties that arise out of or relate in any way to this promotion and the credits offered hereunder, including, but not limited to, where arising out of or relating to the following: (a) any technical difficulties or equipment malfunction (whether or not under Epiphan’s control); (b) any theft, unauthorized access or third party interference; (c) any promotion credit request that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Epiphan, and whether or not in Epiphan’s control); (d) any damages due to the operation of the postal service or courier companies; (e) any tax liability incurred by participant; or (f) use or misuse of the New Epiphan Product offered under the Promotion. |
